1. Acceptance of Terms

By downloading, installing, or using AutoGhost ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

AutoGhost is a mobile application designed to help reduce phone distractions while driving. The App detects vehicle motion using your device's sensors and blocks access to user-selected apps during detected drives.

3. Safety Disclaimer

IMPORTANT: AutoGhost is a tool to help reduce distractions. It does NOT guarantee your safety or prevent accidents.

  • The App is an aid to safe driving, not a substitute for attentive, responsible driving.
  • Driving detection relies on device sensors which may not always be accurate. False positives and false negatives can occur.
  • You are solely responsible for operating your vehicle safely and in compliance with all applicable laws.
  • You must not rely on the App as your only means of avoiding phone distractions while driving.
  • The App does not block all possible distractions (phone calls, system notifications, CarPlay/Android Auto apps, and essential apps remain accessible by design).

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We are not liable for any traffic accidents, injuries, property damage, or other losses that occur while the App is active or inactive.
  • We are not liable for any failure of the App to detect driving, block apps, or function as intended.
  • We are not liable for any consequences of the App incorrectly detecting driving (e.g., while a passenger, on a bus, or on a train).
  • Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

5. User Responsibilities

  • You must comply with all local, state, and federal laws regarding mobile device use while driving.
  • You are responsible for configuring which apps to block.
  • You must not attempt to circumvent the App's blocking mechanisms while driving.
  • You acknowledge that the "I'm Not Driving" feature should only be used when you are genuinely not operating a vehicle.

6. Subscriptions and Payments

  • AutoGhost offers a 7-day free trial and paid subscription plans (Monthly, Annual, Lifetime).
  • Payment is charged to your App Store or Google Play account upon confirmation.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription through your device's subscription settings.
  • Refunds are subject to the Apple App Store or Google Play Store refund policies.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Intellectual Property

All content, features, and functionality of the App are owned by us and are protected by intellectual property laws.

9. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms shall be governed by the laws of England and Wales, without regard to conflict of law provisions.
